In consideration of and as an inducement to my enrollment (or continued enrollment) and payment of fees to become a student of Mojo Fit Studios, LLC (hereinafter “MFS”), the undersigned (“I” or “applicant”) enters into this “Release” and represents and agrees as follows:

1. I have been examined by a licensed physician within the past six months and have been found by such physician to be in good health and fully able to perform all yoga exercises, which I am to learn and perform during my enrollment with MFS. I understand that prior to beginning any exercise routine, I should consult with a medical professional.

2. I will faithfully follow all instructions given to me by MFS instructors as to when and how to perform and not to perform Yoga Exercises.

1. I understand and agree that I the practice of yoga and participating in group physical exercise may expose me to the risk of injury, illness or death. Understanding these risks, I, on behalf of myself, my heirs, my spouse, or other interested party, agree to hold harmless, waive and release MFS, it employees, officers, directors, shareholder, and independent contractor trainers for any damage to, or theft of, personal property on or away from MFS’s premises, or personal injury, including but not limited to bodily injury, disease (including COVID-19), disability, death, humiliation, or consequential loss of any kind arising out of my participation in any MFS event or activity. In the event that I am or become pregnant while a participant at MFS, the foregoing provision applies to any injury to my unborn child/fetus.

   4. In the event that I am pregnant, I will not attend a yoga class until I have discussed the potential risks to me or my unborn child/fetus with my obstetrician. I agree that I will follow my obstetrician’s recommendations.5. If I am under 18 years of age, I warrant that I have disclosed my age to MFS and in addition to my signature, have provided the signature of my parent or legal custodian or guardian below.

   6. Registration fees and Tuition for classes paid hereafter are non-refundable.

   7. Any provision not in conformity with the law of any state or governing body having jurisdiction is hereby severed from this contract and the remaining provisions remain enforceable. Applicant agrees that any dispute regarding this Release will first be tendered by the parties to a member of the American Arbitration Association for resolution prior to the filing of any lawsuit. The applicant also agrees, failing a successful arbitration effort, any suit to be tendered will be filed in and under the laws of the State of North Dakota.

   8. I understand that some instructors make physical adjustments and it is my responsibility to verbalize to indicate if I do not want physical adjustments or contact from MFS or its instructors for each class or workshop that I attend.

   9.I understand that MFS is a public facility in which airborne viruses (including, without limitation, COVID-19) may be present. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS AND ASSUME FULL RESPONSIBILITY FOR MY PARTICIPATION AT MFS. I agree that I will not hold MFS liable for any illness which may be contacted by visiting a public facility and being in proximity with others, and for any allergic reactions to airborne remnants of cleaner within the studio.

   10. I agree not to attend classes at MFS if I have been diagnosed with COVID-19 or know that I have been exposed to someone with COVID-19 until I have passed the timelines set out by the Center for Disease Control. I will follow any guidelines posted by an MFS regarding social distancing and hygiene while at the MFS studio and will cooperate with any requests by a MFS instructor relating thereto.

2. I understand that both MFS and its affiliated instructors are not diagnosing, prescribing, or treating any medical condition. I understand that if I do not feel well, I should consult a medical professional.

   12. I understand I am responsible for the security of my belongings and should keep any valuables with me at all times or should not bring them into the studio.

Autopay Membership Cancellation Policy:

Please complete the link below to process your cancellation request for a Mojo Fit Studios Autopay agreement. Mojo Fit Studios cancellation policy requires a 30 day notice of cancellation. Month to month autopay cancellations will be processed 30 day from the date this request is submitted.

If you are less than 30 days out from your next autopay charge date your charges will be prorated. Thank you!
